Terms of Service for Kanaloa App

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Kanaloa mobile application ("App"), developed and operated by Kanaloa Surf-Tech LLC, an independent developer ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

We may update these Terms at any time. Continued use after changes constitutes acceptance. Check this page periodically.

2. Description of the App

The App provides features for managing locations, viewing maps, and fetching weather conditions. It uses third-party services like Apple Maps for geocoding and StormGlass for weather data. All data is provided "as is" without guarantees of accuracy, completeness, or timeliness.

3. Eligibility

You must be at least 13 years old to use the App. If under 18, you must have parental consent.

4. User Conduct

You agree to use the App only for lawful purposes and in compliance with these Terms. You will not:

Use the App in a way that violates any laws or infringes on others' rights.
Attempt to reverse-engineer, hack, or interfere with the App.
Upload harmful content or use the App for commercial purposes without permission.

We may suspend or terminate access for violations.

5. User Content

Any locations or data you add (e.g., custom pins) are stored locally on your device. You retain ownership but grant us a limited license to use it for App functionality. You are responsible for your content and ensure it doesn't infringe on third-party rights.

6. In-App Purchases and Subscriptions

The App may offer in-app purchases or subscriptions processed through Apple and managed by RevenueCat. All payments are handled by Apple; we do not collect payment details. Subscriptions auto-renew unless canceled via your Apple account at least 24 hours before renewal. Refunds are subject to Apple's policies. Prices may change with notice.

7. Third-Party Services

The App integrates with third parties (e.g., StormGlass for weather, Apple for maps). Their terms apply, and we are not responsible for their content or practices. Links to external sites are for convenience; we do not endorse them.

8. Intellectual Property

The App and its content (excluding your user content) are owned by us or our licensors and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes. Do not copy, modify, or distribute without permission.

9. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY OR FITNESS FOR A PURPOSE. WE DISCLAIM LIABILITY FOR ERRORS IN WEATHER DATA, MAPS, OR ANY RELIANCE ON APP INFORMATION. USE AT YOUR OWN RISK—DO NOT RELY ON THE APP FOR SAFETY-CRITICAL DECISIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

11. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the App, violation of these Terms, or infringement of third-party rights.

12. Termination

We may terminate or suspend your access at any time without notice for any reason, including violations. Upon termination, your license ends, and you must delete the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to its conflict of laws principles. You and we agree to submit to the personal and exclusive jurisdiction of the courts located within Maui County, Hawaii, for any disputes arising out of or related to these Terms. Notwithstanding the foregoing, if you are a resident of the European Union or another jurisdiction where local laws mandate otherwise, these Terms shall be governed by the applicable laws of your country of residence, and disputes shall be subject to the non-exclusive jurisdiction of the courts in your country of residence.
